Zemparant LLC – Tipswe Payment Policy

This Payment Policy applies to all payment transactions offered on the Tipswe mobile application operated by Zemparant LLC. This policy provides information about how payments made by users are processed, which payment methods are accepted and the rights of users regarding payment information.
1. Payment Methods
We accept the following payment methods to provide access to premium content (e.g. Premium predictions) offered in the Tipswe app
– Credit/Debit Card: Common credit and debit cards such as Visa, MasterCard, American Express.
– Mobile Payments: Payment transactions made through Google Play or Apple App Store (you can purchase subscriptions using the payment systems within the Google Play Store or Apple App Store).
– Other Digital Wallets: Payments can be made with digital wallets such as PayPal, Google Pay, Apple Pay.
– Local Payment Methods: Local payment options may also be available for users in different regions.
2. Payment Process
– Registration and Subscription: After registering in the Tipswe app, users can purchase a premium membership to gain access to free and premium predictions. Payment is made through the payment screen within the app. Payment for the premium membership is charged via the users’ chosen payment method.
– Payment Confirmation and Billing: The user will receive an invoice or payment receipt after making payment. This payment will be presented in English. Users can also access pricing information within the app during checkout.
– Subscription Renewal: Premium subscriptions can be purchased to be valid for a specific period of time (e.g. monthly, yearly). The subscription can be renewed automatically. Users can cancel their subscription through the Google Play Store or Apple App Store.
– User Responsibilities: Users are responsible for ensuring that their payment information is accurate and up to date. If incorrect or invalid payment information is entered, the subscription may not be active and the user may not be able to access premium services. The user continues their subscription by providing valid payment information.
3. Subscription and Payment Plans
– Free Plan: Users can access the app’s basic forecasting features for free.
– Premium Plan: A paid subscription is required for the Premium Plan, which includes detailed analytics, live forecasts and more precise predictions. This plan is only accessible to premium users.
Prices may vary depending on the payment plan users select and their region.
-Subscription and Payment Plans: Users can access both free (Free Plan) and premium (Premium Plan) content. A paid subscription is required for the Premium Plan, and users can choose from **1, 3, 6, or 12-month** packages.When the subscription period expires, automatic renewal will occur at the specified fee. Renewal will take place without requiring additional user consent. However, users always have the right to cancel their subscription before the renewal date. Cancellation options will be provided to the user prior to renewal.Cancellation options will be provided to the user prior to the renewal.
-Billing and Device Verification: To ensure that users can avail the free trial only once, the system verifies the user’s device number and Google billing information. If the user has already availed the free trial on that device/account, they will not be able to start another free trial.
4. Collection and Security of Payment Information
Tipswe uses secure payment platforms to enable payment transactions. When users enter credit card, debit card and digital payment information, this information is stored on encrypted secure servers and is not shared with third parties.
– Data Security: Credit card information and payment data is encrypted and securely processed by payment providers. Tipswe does not collect or store payment information.
– Encryption: User payment information is securely transmitted using SSL (Secure Socket Layer) encryption.
5. User Rights and Information
According to GDPR and CCPA, users have the following rights regarding their payment information:
– Right of Access: Users can request information about their payment information and past payments. This can be done through the app or by contacting Tipswe’s support team.
– Right to Data Erasure (Right to be Forgotten): Users can request the deletion of their personal data. However, there may be a legal obligation to retain data for certain payments and transactions.
– Data Portability: Users have the right to move their payment information to another service.
– Data Sale and Opt-Out (Right to Opt-Out): Users who live in California have the right to opt-out against the sale of their personal data. Users have the right to refuse the sharing of their personal data.
6. Subscription Cancellation and Refund Policy
– Subscription Cancellation: Users can cancel their subscription, including the trial period, via **Google Play Store** or **Apple App Store**. Cancellation must be made before the end of the trial period. If the subscription is not canceled, the specified fee will be automatically charged to the user. Canceled subscriptions will continue without charge for the next payment cycle.
– Refund Policy: Payments and subscription fees are non-refundable. Users cannot request a refund after the provision of the service after payment. However, in the event of an implementation error or any other case of deception of the user, the relevant refund policies will apply. Users will not be able to request a refund for canceled subscriptions.
– Notification: When the trial period begins, **Google** or **Apple** will notify the user of subscription renewal and fee collection via email. The user can cancel the subscription with this notification; otherwise, automatic renewal will occur at the end of the trial period.
– Automatic Renewal and Fee Collection: The user agrees that when the subscription is automatically renewed, the fee for the next payment cycle will be charged to the registered payment method. The subscription will renew at the end of each period unless canceled by the user and the specified fee will be charged automatically. Users will continue to be charged unless they cancel their subscription.
– Temporary Access Restrictions: If the user fails to make premium membership payments, access to premium content may be temporarily blocked. Once the subscription is renewed or payment is made, access is restored. Users will only have access to the Free Plan in the absence of payment.
-Users can cancel their subscription at any time before the end of the free trial period without being charged. Cancellations can be made via the app, and no charges will be applied to the user if the subscription is canceled before the trial ends. If the user does not cancel before the end of the trial, the subscription will automatically renew and the stated fee will be charged.
7. Local Laws and Payment Regulations
– CCPA (California Consumer Privacy Act): Users living in California have the right to prevent the sale of their personal data. Users can request that their data not be sold by exercising their opt-out right.
– GDPR Implementation: Users living in the European Union and the European Economic Area have data access, erasure and portability rights in relation to the processing of payment information. It is also possible to withdraw their consent.
8. Price Changes
Tipswe reserves the right to change its pricing policies from time to time. Price changes will be effective at the end of the user’s current subscription period. Users will be notified via email at least **30 days** prior to price changes. Users have the right to cancel their subscription if they do not accept the new prices.
9. Taxes and Fees
Users may be liable for taxes on in-app purchases according to local laws and regulations. Applicable tax rates and surcharges will be displayed through the app when Users checkout.
10.Trial Period and Automatic Renewal:
-Users agree that once the 3-day free trial period starts, their subscription will automatically renew at the end of this period and they will be charged for the subscription package they selected when starting the trial period. When the trial period begins, **Google** or **Apple** will notify the user via email about the automatic renewal. Users may cancel their subscription before the end of the trial period.
-Trial Right Limitation: Users are only eligible for one 3-day free trial. If a user has already used their free trial on a specific device or Google bill account, they will not be eligible for another free trial on that device/account.

12. Contract Amendments
This payment policy may be changed from time to time. Any changes will be announced in the payment policy section within the application and users will be notified. Changes will be effective upon publication.
