Zemparant LLC – Tipswe Terms and Conditions of Use

These Terms and Conditions of Use (hereinafter referred to as the “Terms”) set forth the conditions that apply to accessing and using the Tipswe mobile application (hereinafter referred to as the “Application”) operated by Zemparant LLC. By using the App, you agree to the following terms.

1. Purpose of the App
Tipswe is a mobile application that provides its users with sports predictions and analysis for entertainment purposes. The app does not encourage users to place bets and does not offer any transactions related to betting. The app only provides sports predictions and analysis, which users use for entertainment and information purposes only.
– No Betting: Tipswe does not direct its users to any betting platform. Users are not encouraged to participate in betting and games of chance within the app.
– For Entertainment Purposes: The App provides predictions and analysis for entertainment purposes and is not intended to provide financial gain.
– Legal Compliance: The App provides services only within the framework of legal and ethical rules. Users must comply with the legal regulations of their country and state.

2. User Responsibility
Users are required to use the Tipswe application only for legally permitted purposes. Users may follow the predictions offered through the application, but are not entitled to bet in any way, participate in games of chance or engage in illegal activities.

3. Age Limit and Users
Users under 18 years of age should not access the App. Tipswe only provides services for users over 18 years of age and does not provide services to users under 18 years of age.
– Age Verification: The App does not provide direct age verification. However, by using the App, users declare that they are over 18 years of age. Users under 18 years of age cannot access the services within the app.
– Local Legal Age Limits: Even though Tipswe is an application for entertainment and analysis purposes, the sports betting age limit may vary in each country and state. Users must abide by the legal age limit of their country and state.

4. Registration and Account Information
To access the app, users are required to provide personal information such as name, surname, phone number and e-mail address. In addition, users can register with their Google or Apple account. Users are responsible for the accuracy of the information they provide.
Protection of Personal Data: Personal data is protected in accordance with legal regulations such as GDPR (Europe) and CCPA (California, USA). Users can receive information about their rights regarding the collection and processing of their personal data.

5. Access to Services
The app offers its users three different types of predictions:
– Free Predictions: Predictions provided for free users.
– Premium Predictions: Predictions based on detailed analysis, accessible only to Premium users.
– Live Predictions: Live match predictions are only available for Premium users.

6. Subscription and Payment
– Premium Subscriptions: Users can access premium predictions by subscribing to the premium membership via in-app purchase.
– Subscription Renewal: Subscriptions are offered with an auto-renewal option and users can manage their subscription via Google Play or Apple App Store.
– Refund Policy: Refunds are not issued after payment has been processed. However, in case of an application error or misleading the user, the relevant refund policies may apply.

7. Legal Compliance and Responsibilities
Users must comply with the legal requirements of the country, state or territory in which they are located. This includes the age of participation in sports betting and other relevant regulations. Tipswe does not provide services to users who do not comply with local laws.
– European Union (EU) and United Kingdom: Personal data is protected in accordance with the GDPR and users have information on how their data is processed.
– United States and California (CCPA): Users’ personal data is processed in accordance with the CCPA. Users have the right to opt-out from the sharing or sale of their data.

8. User Rights and Data Processing
– Users can make requests regarding the processing, updating or deletion of their personal data.
– Sharing of Personal Data: Users’ personal data may only be shared securely for legal obligations and service provision purposes. This data will not be sold or rented to third parties.

9. Application Related Prohibitions
Users must not engage in the following activities:
– Providing misleading information, creating fake accounts or impersonating other users.
– Place illegal bets or redirect to prohibited betting sites.
– Abuse of the service, spamming or damaging the application infrastructure.
– Unauthorized copying and dissemination of content provided by Tipswe.
– Failure to respect intellectual property rights

10. Legal Disputes
Any legal disputes between the user and Zemparant LLC will be subject to the exclusive jurisdiction of the courts in the State of Wyoming. User agrees that in the event of any dispute under these terms, User agrees to seek resolution only in the state of Wyoming.

11. Intellectual Property and Content Use
– Ownership of Shared Content: The sports predictions and analysis provided on the Tipswe app are the exclusive intellectual property of Zemparant LLC. Users may view and follow this content for personal entertainment purposes only. Users are prohibited from copying, distributing, publishing, or commercializing this content in any form.
– Dissemination and Sharing of Content: The forecasts and analytics within the App are for personal use only and sharing or publishing on other platforms, websites, social media accounts or third-party applications is strictly prohibited. Users may not copy, transfer or publish this content without permission.
– Legal Sanctions in Case of Unauthorized Sharing: Users may be subject to legal action by Zemparant LLC if they disseminate the shared content in an unauthorized manner or share it on another platform. This may lead to compensation claims or legal proceedings. Zemparant LLC has the right to take any legal steps necessary to protect its intellectual property rights.

12. Account Closure and Sanctions
Tipswe has the right to temporarily or permanently suspend or close users’ accounts if they violate the following prohibitions. In addition, the account may also be closed when suspicious activities are detected. The following situations may result in account closure and other sanctions:
– Sharing illegal or unauthorized content: The user shares, reproduces or publishes content provided on the Tipswe app on other platforms without authorization. The user may not use the app content for commercial purposes and may not share such content with others.
– Story manipulation or identity forgery: The user forges other people’s identities or provides misleading or false information.
– Violation of app policies: The user seriously violates the Tipswe app’s terms of use, privacy policy and other rules.
– Suspicious activities: Tipswe may temporarily suspend a user’s account if Tipswe suspects that the user is engaging in suspicious activities, such as generating artificial traffic, creating multiple accounts, using malicious software or placing illegal bets.
– Infringement of intellectual property rights: The user copies, publishes or commercially exploits content from the Tipswe app without authorization.
Account Closure Process:
Users who violate the prohibitions may be temporarily or permanently denied access to the application. The account closure process will be implemented by Zemparant LLC and will be decided after an evaluation based on the severity of the violation.
– Temporary Account Closure: In case of a first-time violation of the rules, the user may be subject to a temporary ban from the application. During this period, the user may apply for the lifting of the ban, provided that he/she corrects the violated rule and fulfills certain conditions.
– Permanent Account Closure: In case of serial violations or critical violations, the user account may be permanently closed. In this case, the user can no longer access the app content. Permanent closure is done by Zemparant LLC depending on the severity of the violation and the assessments made.
Account Closure for Suspicious Circumstances:
Tipswe may temporarily suspend the accounts of users who are found to be engaging in suspicious activity, during which time the user’s account may be subject to a detailed review. Examples of suspicious activities:
– Artificial traffic generation,
– Create multiple accounts,
– Identity manipulation,
– Sharing illegal content,
– Copying and disseminating content in violation of intellectual property rights,
– Using software that threatens security.
In such cases, users’ account may be temporarily closed and the status of the account will be determined after a detailed investigation. Unauthorized copying and dissemination of content is considered a serious violation and may lead to permanent account closure.
Legal Sanctions:
Tipswe reserves the right to initiate legal action in relation to the above-mentioned violations. In case of infringement of intellectual property rights, illegal betting activities and other illegal actions, Zemparant LLC may impose sanctions such as demanding compensation or initiating legal proceedings.

13.Disclaimer of Liability
– The App receives data such as instant and end-of-match scores and minutes from third-party providers and makes it available to users. These third parties are solely responsible for the accuracy and speed of updating this data. The application does not guarantee the accuracy of this data and shall not be held liable for any losses or damages caused by errors, omissions, or delays. Users acknowledge that the data is provided for informational purposes only and agree to exercise caution when making decisions based on such data.
– The Application offers sports predictions to its users. However, the predictions provided are for entertainment and informational purposes only. Users agree not to make any financial transactions, bets or investments based on these predictions. The Application does not guarantee the accuracy or success rate of the shared predictions. Users agree that if they make any transactions using the predictions, they will be fully liable for any financial losses that may occur. Tipswe app and Zemparant LLC is not liable for any damage or loss caused by the estimates made available to users.

14. Contract Modifications
– These Terms of Use may be amended from time to time. Users are obliged to follow these changes. Changes are notified to the user via updated versions within the application.
